JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-12-2018 The petitioner seeks bail in connection with Lalganj P.S.Case No. 90 of 2018 registered under Sections 399, 402 and 414 of the Indian penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

Allegation as per the FIR is that police, on receiving information that some miscreants have assembled on the road with the intention to commit some crime, raided there and arrested some accused persons and on their information, petitioner and others were arrested and one loaded country made pistol was recovered from the possession of the petitioner. Further, it appears that one pickup van was also recovered there. It appears from para-3 of the application that petitioner is accused in five other cases.

Submission of learned counsel for the petitioner is that

Patna High Court Cr.Misc. No.64875 of 2018(3) dt.14-12-2018 2/2 petitioner has been falsely implicated in this case and there is no seizure of the pickup van in the case diary and that has also not been mentioned on his confessional statement and petitioner is in custody for more than 08 months.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 90 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
