====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 15-10-2019 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in a case registered for the offences punishable under Sections 10, 13, 18, 20, 38 and 39 of the U.A.P. Act.

Submission is that the FIR would reveal that some other co-accused were apprehended by the police on suspicion that they were Nuxals and in their statement, name of the petitioners surfaced. Thereafter, from possession of the petitioners, a motorcycle was recovered which is alleged to be a stolen article. Petitioners have stated on oath that they have got no criminal antecedent. They are in custody since 06.05.2019. Investigation of the case is already complete against the

Hence, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sherghati (Dobhi) Police Station Case No. 199 of 2019, subject to the following conditions:- (a) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioners.

(b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
