The petitioner seeks regular bail in connection with Agam Kuan P.S. Case No. 508 of 2018 registered for the offence punishable under Sections 452,385,307/34 of the Indian Penal Code and Section 27 of the Arms Act.
The allegation in the present case is regarding main accused person namely Sanjees Kumar Singh having entered into the house of the informant and fired gun-shots on the informant and her two daughters resulting in fire-arm injuries to them. It is further alleged that upon alarm the witnesses had arrived at the spot, whereafter, the said main accused fled away from the spot and thereafter it transpired that the petitioner had brought the main accused namely Sanjees Kumar Singh on
Patna High Court Cr.Misc. No.70626 of 2018(4) dt.10-01-2019 2/2 his motorcycle at the place of occurrence.
Learned counsel for the petitioner submits that the petitioner has got no role to play in the alleged incident since it is apparent from the FIR that the petitioner had merely transported the main accused to the place of occurrence. The petitioner is stated to be having a clean antecedent and he is languishing in custody since 22.07.2018.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the abovenamed petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Patnacity, in connection with Agam Kuan P.S. Case No. 508 of 2018.
