====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 11-01-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Bettiah (Muffasil) Manuapul P.S. Case No. 17 of 2018, instituted for the offence under Sections 147, 148, 149, 341, 342, 447, 323, 324, 307, 376, 511, 504, 506 of the Indian Penal Code. Subsequently, Section 302 and Section 8 of Prevention of Children from Sexual Offences Act, 2012 were added.

It is alleged in the written report that Zakir Ansari assaulted uncle of the informant (since deceased) by means of iron rod on his head. Thereafter, the petitioner along with other co-accused as named in the written report assaulted uncle of the informant (since deceased) with Bamboo, lathi, etc. The

Patna High Court Cr.Misc. No.74338 of 2018(3) dt.11-01-2019 2/2 uncle of the informant died in Hospital during course of treatment.

Case diary has been received.

Post mortem report is available in the case diary wherein the Doctor has found only one injury on the head of the deceased.

Petitioner is in custody since 15.9.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-1st, West Champaran at Bettiah, in connection with Bettiah (Muffasil) Manuapul P.S. Case No. 17 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
