The petitioner seeks regular bail in connection with Abadpur P.S. Case No. 109 of 2018 for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The allegation in the present case is that the police upon confidential information, conducted a raid and apprehended one person namely Tarak Das with a bag containing illicit liquor totaling to 26.1 liter as well as one motorcycle. It is further alleged that the motorcycle belongs to the petitioner herein.
The learned counsel for the petitioner submits that neither recovery has been made from the person of the petitioner
Patna High Court Cr.Misc. No.70734 of 2018(4) dt.10-01-2019 2/2 nor the petitioner was caught with illicit liquor and it was the co-accused person, namely, Tarak Das, who was carrying the said illicit liquor. The petitioner is languishing in custody since 07.09.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge cum Special Judge, Katihar in connection with Abadpur P.S.
