====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 26-09-2019 The petitioner was granted bail vide order dated 23.08.2019 in Cr. Misc. No. 51590 of 2019 with a condition that the petitioner shall deposit Rs. 2 Lakhs cash and on deposit of Rs. 2 Lakhs, the Court below shall release the petitioner on bail bond.

The present writ application has been filed for modification of the condition granting bail. A supplementary affidavit has been filed on behalf of the petitioner where the petitioner has submitted that the petitioner is ready to deposit cash of Rs. 1 Lakh in compliance of the order dated 23.08.2019 passed in Cr. Misc. No. 51590 of 2019.

Considering the aforesaid statement made on behalf of the petitioner, the order dated 23.08.2019 passed in Cr. Misc.

Patna High Court CR. MISC. No.60999 of 2019(2) dt.26-09-2019 2/2 No. 51590 of 2019 is modified to the extent that instead of 'cash deposit of Rs. 2 Lakhs' should be read as cash deposit of Rs. 1 Lakh (One Lakh) in the Court below and on deposit of the same, the Court below shall release the petitioner on bail. The cash deposit of Rs. 1 Lakh shall abide by the final outcome of the pending criminal case.
