The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 22, 23, 24, 27, 29, 20 of the N.D.P.S. Act.
As per prosecution case, informant got information that one person carrying smack is carrying nearly Bilanpur. The informant along with police personnel went there and arrested co-accused namely, Yogendra Rai. On search, 80 packets of smack were recovered from his possession who disclosed that he used to buy smack from this petitioner.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The petitioner has no
Patna High Court CR. MISC. No.64902 of 2022(2) dt.24-02-2023 2/2 concern with the alleged recovery of smack or with the coaccused. The name of the petitioner has been disclosed in this case by the apprehended person namely, Yogendra Yada from whose possession, the incriminating smack has been recovered. He has got no criminal antecedent. It is further submitted that the petitioner is languishing in judicial custody since 29.7.2022. Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Lalganj P.S. Case No. 200 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Vaishali at Hajipur.
