1. Heard learned counsel for the parties.
2. The petitioners have preferred this application for grant of regular bail in connection with Rajpur P.S. Case no. 71 of 2023 registered under sections 302, 120B and 201 of the Indian Penal Code.
3. As per the prosecution case, the informant states that dead body of a lady was recovered which led to filing of the FIR.
4. Learned counsel for the petitioners submits that the FIR was registered against unknown. The petitioners were falsely implicated in course of investigation because they happen to be the father and mother of the deceased. The
Patna High Court CR. MISC. No.71699 of 2023(4) dt.05-03-2024 2/2 deceased committed suicide by hanging herself. The petitioners are in custody since 11.7.2023 and as per instructions received, charge has been framed in the learned trial Court.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties, having perused the material on record and taking into consideration the facts and circumstances of the case, the petitioners being the parents of the deceased, their being in custody for 7 months since 11.7.2023, not having any criminal antecedent and investigation in the case having concluded, both the petitioners are directed to be enlarged on bail in connection with Rajpur P.S. Case no. 71 of 2023, on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar.
