By the impugned order the learned court below has directed the defendant in a suit for partition to lead evidence first in view of the pleading of the defendant that there had already been partition of the joint family properties. After considering the submissions and perusal of the materials on record, this Court does not find that the learned court below has committed any error or illegality in passing the impugned order.
