The petitioner seeks bail in anticipation of his arrest in connection with Sabour P.S. Case No. 250 of 2018 dated 17.08.2018 instituted for the offences under Sections 341, 323, 307, 379, 448, 504, 506 and 34 of the Indian Penal Code.
It has been alleged in the FIR that the petitioner had called the informant for settling some dispute. On the informant not responding to the call of the petitioner, he was assaulted by the petitioner by means of a hard and blunt substance causing lacerated wound on his parietal region. The other injuries suffered by the informant are in the nature of swelling and superficial abrasion on other non-vital portion of his
Patna High Court Cr.Misc. No.71572 of 2018(3) dt.09-01-2019 2/2 body. A complaint case also has been lodged by the petitioner against the informant and others.
It appears that the petitioner as well as the informant are neighbours and there is a pending dispute or else the informant would not have stated that he was called by the petitioner for talking about some land dispute.
Considering the aforesaid facts viz. the nature of the accusation and the circumstances in which the occurrence took place as well as the clean antecedent of the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Sabour P.S. Case No. 250 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
