JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-09-2025 Heard learned counsel appearing on behalf of the petitioner, learned APP appearing on behalf of the State and learned counsel appearing on behalf of the informant.
2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 191(2), 191(3), 126(2), 115(2), 118(1), 117(2), 109, 76, 303(2), 352 and 351(2) of the B.N.S..
3. As per prosecution case, it is alleged that on the instigation of Md. Shamsher, this petitioner assaulted on the head of husband and father-in-law of informant by means of Farsa.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has

As a matter of fact, petitioner is own Dewar (brother-in-law) of informant and on account of partition dispute between the parties, a free fight took place in which both sides sustained injuries. There is case and counter-case. Doctor has opined the injuries, allegedly caused by this petitioner, as simple in nature.

Learned A.P.P. for the State and learned counsel appearing on behalf of the informant have vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R. with specific accusation that this petitioner assaulted on the head of husband and father-in-law of informant by means of Farsa. It is further submitted that the injured sustained incised wound on the head. Petitioner has got four criminal antecedents.
6. Considering the facts and circumstances of the case, relationship between the parties, case and counter-case and nature of injuries sustained by the injured, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount
