The petitioner is in custody in connection with Jagdishpur P.S. Case No. 320 of 2018 for the offences under Sections 302, 504 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal history and he is in custody since 01.09.2018.
Learned counsel for the petitioner submits that from the prosecution case it would be evident that the petitioner has gone to Bettle Shop and asked for Cold Drink. He submits that from the allegation it is evident that petitioner has no intention to cause serious injury to the informant otherwise they have used the fire arm instead of using Butt of the Rifle.

No.71642 of 2018(3) dt.09-01-2019 2/2 Considering the period of custody and the fact that petitioner has no criminal antecedent, let the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Learned Additional Chief Judicial Magistrate, Bhojpur at Ara in connection with Jagdishpur P.S. Case No. 320 of 2018.
