The petitioner apprehends his arrest in connection with Thawe P.S. Case No. 27 of 2019, registered under Section 420 of the Indian Penal Code and Section 30(a), 35 and 38 of the Bihar Excise Act, 2016.
The accusation is that on receiving information about keeping of illicit liquor in Village- Sahorwa at canal in water tank by Munna Manjhi (petitioner) and Sunni Singh, the informant along with other police personnel reached there. On seeing police party, two persons present there succeeded to flee away. On search, 280 cartoons containing 48 bottles of 180 ml Indian made foreign liquor recovered. On query, Kamlesh
Patna High Court CR. MISC. No.67306 of 2019(2) dt.14-11-2019 2/2 Kumar, who present there, disclosed the name of Munna Manjhi (petitioner) and Sunni Singh, who succeeded to flee away. Learned counsel for the petitioner submits that petitioner and Sunni Singh were not apprehended at the spot rather their names have been disclosed by Kamlesh Kumar with ulterior motive. Further submission is that petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Excise, Gopalganj, in connection with Thawe P.S. Case No. 27 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
