JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-01-2019 As prayed for, learned counsel for the petitioner is permitted to make necessary correction in paragraph-20 of the application during the course of the day, Heard learned counsel for the petitioner and learned APP for the State.

Petitioner is in custody in connection with Parsabigha PS Case No. 86 of 2018 for the offence under Sections 302 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the case merely on the basis of suspicion. It is submitted that even in confessional statements of some co-accused the name of the petitioner did not find mention. He further submits that petitioner is in custody

Patna High Court Cr.Misc. No.72385 of 2018(3) dt.10-01-2019 2/2 since 15.07.2018.

Learned counsel representing the informant submits that similarly circumstanced persons have been directed to be released on bail after 21.03.2019 and as such the petitioner may also be granted bail after 21.03.2019.

Considering the aforesaid, the petitioner, named above, is directed to be released on bail after 21.03.2019 on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad in connection with Parsabigha PS Case No. 86 of 2018.
