Petitioners seek bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
36 litres of liquor was recovered from the motorcycle of the petitioners. Petitioner No.2, Anish Kumar has got identical criminal antecedent. Petitioner No.1, Pawan Kumar Ram has got no criminal antecedent and investigation against petitioner No.1 is already complete.
Hence, let petitioner No.1, Pawan Kumar Ram be released on bail at once and petitioner No.2, Anish Kumar be released on bail if the trial is not concluded within six months

No.60276 of 2019(2) dt.01-10-2019 2/2 from the date of framing of the charges on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Mirganj Police Station Case No.196 of 2019, subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below and the petitioners shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioners.
