JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-02-2020 Petitioner seeks regular bail in connection with Sessions Trial No. 07 of 2018 arising out of Danapur P.S. Case No. 364 of 2017 registered for the offence punishable under Sections 341, 342, 323, 307, 504, 34, 415, 302 of the Indian Penal Code and Section Section 27 of the Arms Act. Earlier prayer for bail of the petitioner was rejected vide order dated 13.11.2017 passed in Cr. Misc. No. 50786 of 2017. Petitioner is one of the assailant of the deceased by firearm.
Submission of learned counsel for the petitioner is that he has in custody since 14.06.2017. Three witnesses have been examined and they have been declared hostile and after that no witnesses have been examined. There is no possibility of accusation of trial in the future.

In view of the allegation, I am not inclined to grant bail to the petitioner but petitioner is in custody for more than 2 and 1⁄2 years. The learned trial court is directed to see that the case be conducted on regular basis so that the trial may be concluded expeditiously. At the same time Superintendent of Police, Patna is directed to ensure the presence of the petitioner on the date fixed otherwise this Court will be forced to proceed against the officer concerned for the lapses.
