Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 379/504/506/308/34/307 and other allied sections of the Indian Penal Code.

Prosecution's case in short is that the petitioner and other accused persons assaulted the informant side with fists and slaps and iron rod and also snatched gold chain and cash Rs.5000/-.

Learned counsel appearing for the petitioners submits that parties are next door neighbourer and admittedly there is

Patna High Court CR. MISC. No.65658 of 2022(2) dt.04-04-2023 2/2 land dispute. There is case and counter case lodged by the mother of the petitioners against the informant side. Similarly situated co-accused has already been allowed bail by a coordinate bench of this Court vide order passed in Cr.Misc.No. 61117/2022. Petitioners have got no criminal antecedent. Considering the nature of allegation against the petitioners, in the event of arrest/surrender within six weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate II, Gaya in Belaganj Police Station Case No. 157 of 2021, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
