The petitioner seeks bail in anticipation of his arrest in connection with Mohiuddin Nagar P. S. Case No. 96 of 2018 dated 16.06.2018 instituted for the offences under Sections 143, 144, 145, 147, 148, 149, 151, 152, 153, 153(A), 153(B), 290, 291, 295, 295(A), 298, 341, 342, 324, 326, 307, 332, 333, 337, 338, 353, 427, 504 and 120(B) of the Indian Penal Code.

It has been submitted on behalf of the petitioner that with respect to the burial of a dead person, a fight took place between the members of two communities leading to loot and arson. Around seventy five persons have been made

Patna High Court Cr.Misc. No.73434 of 2018(3) dt.15-01-2019 2/2 accused in this case. Though the petitioner has been named in the F.I.R., but nothing specific has been alleged against him. It has further been submitted that under similar circumstances, many of the accused persons have been granted anticipatory bail by different Benches of this Court. Considering the aforesaid facts as also taking into account that the petitioner does not have any criminal antecedents, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur in connection with Mohiuddin Nagar P. S. Case No. 96 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
