The petitioner apprehends his arrest in Darihat P.S. Case No. 125 of 2022, registered for the offence punishable under Sections 272, 273 and 420 and other allied sections of the Indian Penal Code and sections 30(a), 31, 32(i)(ii), 36, 41 and 45 of the Bihar Prohibition and Excise Act, 2018. 2232 litres of foreign liquor has been recovered from the container of a truck.

It is submitted that nothing has been recovered from conscious possession of this petitioner. Petitioner is neither driver nor owner of vehicle in question.

Counsel for the State vehemently opposed the bail

Patna High Court CR. MISC. No.64920 of 2022(3) dt.22-12-2022 2/2 application and submitted that petitioner has got criminal antecedent of similar nature.

Considering the fact that petitioner is having criminal antecedent of similar nature, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
