Petitioner is apprehending his arrest in connection with Hisua (Hasua) P.S.Case No.144 of 2019 , registered for offences punishable under Sections 341, 323, 504, 506, 307/34 of the Indian Penal Code and Section 27 of the Arms Act. As per the FIR, the petitioner and other accused persons were taking toddy when the informant came there, one Dharmendra Singh ordered and one Sanni Kuamr Singh fired on the informant and Chandan Kumar fired on the nephew of the informant . There is also allegation against this petitioner of firing.
Submission of the learned counsel for the petitioner is
Patna High Court CR. MISC. No.60270 of 2019(2) dt.24-09-2019 2/2 that the specific allegation has been attributed against the petitioner and he has been falsely implicated in this case, having no criminal antecedent.
Heard learned A.P.P. and the learned counsel for the informant, who has opposed the prayer for bail. Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, surrender before the learned court below within a period of two weeks from the date of receipt of the order and on surrender he will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Nawada in connection with Hisua (Hasua) P.S.Case No.144/2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
