The petitioner apprehends his arrest in connection with Gwalpura P.S. Case No.55 of 2021, registered for the offences punishable under Sections 147, 148, 504 and 506 of the Indian Penal Code as well as under Section 27 of the Arms Act. The petitioner and other co-accused persons are said to have surrounded the house of the informant and made indiscriminate firing.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner has got one criminal antecedent as stated in paragraph-3 of the bail petition in which the police has submitted final form against the petitioner. It is further

Patna High Court CR. MISC. No.65306 of 2022(2) dt.24-02-2023 2/2 submitted that there is general and omnibus allegation against the petitioner. It is also submitted that similarly situated coaccused person has already been enlarged on anticipatory bail by a co-ordinate Bench of this Court vide order dated 01.11.2022, passed in Cr. Misc. No.31527 of 2022. The learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioner. Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Madhepura in connection with Gwalpura P.S. Case No.55 of 2021, subject to the conditions laid down under Section 438 (2) of the Code of Criminal Procedure.
