JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-04-2019 This is an application for grant of anticipatory bail in connection with Rafiganj P.S. Case No. 196 of 2018, disclosing offences under Sections 147, 148, 149, 341, 323, 324, 353, 427, 224, 225, 307, 338, 379, 504, 333, 332 and 393 of the Indian Penal Code.

Allegation as per F.I.R. is that the informant along with other police party had gone to execute one Rajendra Yadav and while the police party was going then some other accused persons including the petitioner have attacked on the police party.

Submission of learned counsel for the petitioner is that in this case altogether 26 persons are named in the F.I.R. along with 50 other unnamed accused persons. Further submission is that no specific allegation has been attributed

Patna High Court CR. MISC. No.74772 of 2018(4) dt.11-04-2019 2/2 against the petitioner and he has no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad, in connection with Rafiganj P.S. Case No. 196 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
