The petitioner is in custody in connection with Pirbahor P.S. Case No. 500 of 2018, registered for the offence punishable under Sections 420, 274, 275, 276, 467,468/120 (B) of Indian Penal Code and Section 27 ( C), 28 (a), 27 (b) (ii), 27 (d) of Drugs and Cosmetics Act, 1940 (Amendment 2008). Learned counsel for the petitioner has made manifold submissions including the legality of lodging the FIR in the instant case. Referring to the supplementary affidavit he submits that the drugs which is the subject matter of the present case was found of standard quality in lab test.

Considering the facts that drugs was found of standard quality as per lab report, let the petitioner named above is

Patna High Court Cr.Misc. No.73442 of 2018(4) dt.25-01-2019 2/2 directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Patna in connection with Pirbahor P.S. Case No. 500 of 2018.
