Petitioner is in custody in connection with Sherghaty P.S. Case No. 366 of 2019 for the offence under section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner would submit that petitioner has no criminal antecedent.

Learned counsel submits that in the instant case total 45 liters of mahua wine was seized from the joint possession of the petitioner and co-accused Ranjeet.

The petitioner is in custody since 7.8.2019.

Considering the fact that petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on

Patna High Court CR. MISC. No.60813 of 2019(2) dt.26-09-2019 2/2 furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Gaya, in connection with Sherghaty P.S. Case No. 366 of 2019.
