JUSTICE SANJAY PRIYA ORAL ORDER 18-01-2019 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in connection with Khudwa P.S. Case No. 47 of 2013 instituted for the offence under Section(s) 147/148/149/427/302 of the Indian Penal Code, Section 27 of Arms Act, Sections 3/4 PDPP Act, Sections 3/4/5 of Explosive Act, Sections 10/20 of UAPA Act and Section 17 of CLA Act .
Learned counsel for petitioner submits that petitioner has been remanded in this case on 19.12.2017. The FIR has been lodged against 7 named and 50 unknown accused persons. The name of this petitioner has come during investigation on the basis of confessional statement of co-accused Vijay Singh. It has further been submitted that Vijay Singh has already been
Patna High Court Cr.Misc. No.72611 of 2018(3) dt.18-01-2019 2/2 granted regular bail by co-ordinate Bench of this Court by order dated 04.03.2015 passed in Cr. Misc. no. 3841 of 2015. Learned counsel for the informant has appeared and opposed the prayer for bail. He submits that several cases are pending against this petitioner.
Keeping in view the period of custody already spent by the petitioner in custody and the fact that he is not named in the written report, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Khudwa P.S. Case No. 47 of 2013 subject to the condition that both the bailors shall be the close relative of the petitioner.
