The petitioners apprehend their arrest in connection with Sakra P.S. Case No. 332 of 2019, registered under Sections 341, 323, 504, 506, 379 and 308 of the Indian Penal Code. The accusation is that five persons named in the F.I.R. including the petitioners entered in the house of informant, Md. Samim, and started to abuse and cause assault to him. At that time, Md. Chand, Mahbub Alam (petitioner no.2) and Md. Makshud Alam (petitioner no.1) with intention to kill him started to assault through iron rod causing injury at his head. Thereafter, they also assaulted his

Learned counsel for the petitioners submits that petitioners are next door neighbour of the informant and due to some dispute, occurrence took place, in which, petitioners' side also sustained injury, regarding which, Sakra P.S. Case No. 336 of 2019 is also instituted on the basis of written report of daughter of petitioner no. 2. Moreover, the injury, as found on the person of the informant, is simple in nature. Further submission is that petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned Sub-Judge-XIII-Cum-ACJMIV, Muzaffarpur, in connection with Sakra P.S. Case No. 332 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
