2. The petitioner is apprehending his arrest in connection with Khagaria P.S. Case No. 43 of 2025 for the offence under sections 126(2), 115(2), 118(1), 109, 74 and 3(5) of the BNS lodged on 06.02.2025 by the informant, Sunil Kumar.
3. As per the prosecution story, the informant alleged that the accused persons with intention to kill attacked the informant's side. Specific allegation against Raju Kumar is of assaulting with spade on the head of the informant's sister-inlaw (bhabhi) namely, Anjali Bharti causing injury to her. The
Patna High Court CR. MISC. No.65661 of 2025(2) dt.17-09-2025 2/2 other accused persons also assaulted his younger brother Lalan Kumar and nephew, Yashmit Kumar as also assault on the informant also took place. This led to the FIR.
4. Learned counsel for the petitioner submits that only one assault allegation is on the petitioner, which caused injury to the Bhabhi of the informant.
5. Learned APP and learned counsel for the informant has taken this Court to the learned Sessions Judge order to show that the injury has been found to be grievous in nature.
6. Considering the allegation that has come against the petitioner of causing grievous injury to the informant's sister-in-law, no relief can be granted.
7. The anticipatory bail application stands rejected.
8. If, however, the petitioner surrenders within four weeks, the concerned Court shall take up the matter and dispose it of preferably on the same day.
