====================================================== CORAM: HONOURABLE MR. JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 05-03-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application for regular bail arises out of Kamtaul P.S. Case No. 35 of 2018 (Sessions Trial No. 481 of 2018), disclosing the offences under Sections 341, 342, 323, 307 and 302/34 of the Indian Penal Code.

Seen the report dated 04.12.2019 submitted by learned Additional District & Sessions Judge-V, Darbhanga, from which it transpires that the evidence of the defence has been closed and the record was posted for final argument of the case. It has also been mentioned that two months time may be required for disposal of the case, which period has already elapsed.

Patna High Court CR. MISC. No.63291 of 2019(5) dt.05-03-2020 2/2 In such circumstance, I am not inclined to consider the petitioner's case for grant of regular bail as the trial is either concluded or at the final stage.

This application is disposed of with obserbvation that in case the trial is finally not concluded within two months from today, the petitioner shall be at liberty to renew his prayer for bail.

It goes without saying that the parties before the court below shall cooperate in conclusion of the trial, if not already concluded.
