2. Petitioner seeks regular bail in connection with Khaira P.S. Case No. 233 of 2024 dated 08.06.2024 registered for the offences punishable under sections 363, 366A read with section 34 of the Indian Penal Code and later on, section 4 of the POCSO Act was added.

3. The main submissions advanced by petitioner's counsel are that the petitioner bears no criminal antecedent and has been languishing in jail since 14.04.2025 and against him the investigation has been completed and the informant's

No.67545 of 2025(3) dt.10-12-2025 2/3 daughter, who is said to be the victim, has recorded her statement before the Judicial Magistrate, in which she denied the allegations levelled in the FIR rather she accepted her matrimonial relationship with the petitioner and her statement has been discussed in the trial court's order. It is lastly submitted that after the marriage, the informant's daughter and the petitioner lived in a conjugal relationship in Punjab for one year, though the victim's age has been shown to be below 18 years at the time of commission of the alleged occurrence but her age has not been determined in a proper manner in the light of the settled law, however, the petitioner, who is a 25 year old person, has suffered a lot.

4. No one appears on behalf of the informant despite the notice through ordinary process having been served upon him.

5. Though learned APP for the State has opposed the prayer of the petitioner but fairly accepts that the victim accepted her matrimonial relationship with the petitioner before the Judicial Magistrate.

6. Considering the aforesaid submissions and mainly the petitioner's custody period, his fair and clean antecedent and completion of investigation against him and coupled with his

Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in connection with Khaira P.S. Case No. 233 of 2024.
