2. The petitioners apprehend arrest in connection with Muffasil P.S. Case No. 158 of 2025 dated 13.04.2025, instituted for the offence punishable under Sections 80(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, the petitioners and other accused persons are alleged to have strangulated the informant's daughter to death due to non-fulfillment of demand of dowry under conspiracy.
4. Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.65857 of 2025(2) dt.17-09-2025 2/3 petitioners are innocent and they have been falsely implicated in this case. It is further submitted that petitioner no. 1 is the grandmother-in-law of the deceased and petitioner no. 3 is cousin of husband of deceased and petitioner no. 2 is wife of petitioner no. 3. It is next submitted that there is no specific allegation against the petitioners rather the allegation levelled against the petitioners are general and omnibus in nature. It is next submitted that similarly situated co-accused person namely, Sushila Devi has been granted bail vide order dated 12.08.2025 passed by a co-ordinate Bench of this Court in Criminal Miscellaneous No. 52470 of 2025. Lastly, it has been submitted that petitioners have no criminal antecedents.
5. Learned A.P.P. has opposed the prayer for bail of the petitioners.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner within a period of six weeks from today, in connection with Muffasil P.S. Case No. 158 of 2025, they shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Samastipur, subject to condition as laid down under
