Petitioner is in custody in connection with Khagaria PS Case No. 230 of 2018 for the offence under Sections 8/20(b) (ii)(c), 25 and 29 of NDPS Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. In fact the petitioner is the driver of the truck and he is not aware that contraband was kept inside the truck. In this case, case diary was called for. With reference to the case diary, learned APP submits that huge quantity of ganja was recovered from the truck of which the petitioner was the driver. It is true that huge quantify of ganja was recovered from the truck but the real owners of the truck managed to escape taking benefit of darkness and the petitioner

Patna High Court Cr.Misc. No.72428 of 2018(3) dt.10-01-2019 2/2 was falsely implicated in the case.

Considering the totality of the facts situation, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Khagaria-cum-Special Judge, NDPS Case in connection with Khagaria PS case No. 230 of 2018 on the condition that bailors should be local people having sufficient landed property.
