JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-10-2019 This application has been filed for transfer of Sessions Trial No. 37 of 2019, arising out of Kishanganj P. S. Case No. 547 of 2018 registered under Sections 304B/34 of the Indian Penal Code, from the court of District and Sessions Judge, Kishanganj to any sessions division court of Kishanganj. Submission of learned counsel for the petitioner is that he has filed some documents but learned Sessions Judge has not accepted the same and directed the court master not to give any receipt of the same as he has to move the High Court for transfer of the case. On the other hand, learned counsel for opposite party No.2 has submitted that the case has been fixed for defence and no defence witness has been produced by the

Patna High Court CR. MISC. No.67580 of 2019(2) dt.24-10-2019 2/2 petitioner and later on a petition has been filed stating that he has to move the High Court for transfer of the case in order to delay and the whole allegation is false and concocted. Having heard both sides and in the facts and circumstances, I find no merit in this application. This application is, accordingly, dismissed.
