2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Sections 30 (a), 32, 41(i) of the Bihar Prohibition and Excise Act.

3. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that no incriminating article has been recovered from the conscious physical possession of the petitioner rather 70 liters of country made liquor and 6000 litres of raw materials is said to have been recovered from the place of occurrence. He submits that there is no specific overt act against the petitioners. Petitioner has three criminal antecedent of similar nature as mentioned in para-3 of this application.

4. However, learned APP for the State opposes the prayer for bail submits that the petitioner is the member of syndicate who manufacturing the illegal liquor.

5. Having regard to the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Kesariya P.S. Case No. 603 of 2022. (Anjani Kumar Sharan, J) devendra/- U T
