1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Harsidhi P.S. Case no.486 of 2023 registered under sections 272, 273, 353, 504 and 34 of the Indian Penal Code and sections 30(a), 30(d), 32, 34, 36 and 41(1) of the Bihar Prohibition and Excise Act, 2016.
3. As per the prosecution case, it is stated by the informant that on secret information having been received about the accused persons having assembled and kept liquor, a raid was conducted. On seeing the police personnel, the accused started to run but five of them including the petitioner were caught while the five others managed to escape. A total of 350 litres of spirit and other equipment for manufacture of liquor was recovered from the mango orchard of one Sanjay Kumar

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. He has neither any concern with the seized articles nor with the co-accused Sanjay Kumar Singh from whose mango orchard the alleged recovery is said to have taken place. He is in custody since 2.8.2023.

Having heard learned counsel for the parties and taking into consideration the nature of allegation in the F.I.R together with the petitioner being in custody since 2.8.2023, the petitioner is directed to be enlarged on bail in connection with Harsidhi P.S. Case no.486 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, East Champaran at Motihari.
