Petitioner seeks bail in a case registered for the offences punishable under Sections 386, 341, 307/34 of Indian Penal Code and Section 27 of Arms Act.
Petitioner is accused in the instant case wherein the informant was subjected to violence for extortion. The learned Senior Counsel submits that merely on suspicion, the petitioner has been implicated in this case. The implication is having regard to the large number of earlier cases pending against him and otherwise without any basis.
Patna High Court CR. MISC. No.60269 of 2019(4) dt.11-12-2019 2/2 Learned counsel for the informant as well as the learned APP for the State have pointed out that during course of investigation, the mobile phone, from which the extortion call was made as well as the weapon used for firing upon the informant, were recovered from possession of the petitioner. Having regard to the criminal background, on basis of large number of cases pending against the petitioner as well as the material collected during course of investigation, this Court is not inclined to allow the prayer of petitioner for bail. Same is rejected.
