JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-01-2019 Petitioner apprehends her arrest in connection with Rupaspur P.S. Case No. 326 of 2018 registered for the offences punishable under Sections 304B, 302 and 34 of the Indian Penal Code.
Allegation against the petitioner, who happens to be married Nanad of the deceased, is of causing death of deceased. Submission of learned counsel for the petitioner is that as a matter of fact she committed suicide and petitioner being married Nanad has falsely been implicated and no specific allegation has been attributed against her.
Heard learned APP and learned counsel for the informant also.
Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.73001 of 2018(3) dt.25-01-2019 2/2 circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Danapur, in connection with Rupaspur P.S. Case No. 326 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
