The petitioner seeks bail in a case registered under Sections 356, 379 of the Indian Penal Code.
Allegation is that three unknown persons snatched the bag of the informant containing Rs.8000/-, one I. Pad of apple company, mobile, two sim cards, ATM card and aadhar card. It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.07.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case due to previous enmity. The petitioner is not named in the F.I.R. His name has come in course of
Patna High Court CR. MISC. No.68384 of 2019(2) dt.25-10-2019 2/2 investigation. Sim card of the petitioner is alleged to have been used in a stolen mobile. The petitioner had no knowledge that the mobile in question is stolen property.
On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Khagaria in connection with Alauli P.S. case No.141 of 2019.
