2. The petitioner apprehends his arrest in a case registered for offence under Sections 137(2), 96 of the B.N.S.

3. As per F.I.R., this petitioner kidnapped the daughter of the informant for the purpose of marriage.

4. Learned counsel for the petitioner submits that the victim, in her statement recorded under Section 183 of B.N.S.S., has denied the factum of kidnapping and stated that she, out of her own volition, went with this petitioner and solemnized marriage with him. As per F.I.R., the age of the victim is 16 years and as such, relying on an order of the Division Bench of this Court dated 23.09.2010 in Cr.W.J.C. No. 991 of 2010 (Sahebi Khatoon @ Sahebi Versus State of Bihar and other),

Patna High Court CR. MISC. No.67053 of 2025(2) dt.22-09-2025 2/2 learned counsel for the petitioner submits that this Court has directed to treat a girl as major in case her age assessed to be between 16 to 17 years.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - VII, Bhojpur at Ara in connection with Dhangai P.S.
