The petitioners seek bail in connection with Piprakothi P. S. Case No. 110 of 2018 instituted for the offence under Section(s) 302/120B/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for petitioners submits that besides suspicion there is no allegation of specific overt act against these petitioners.
The allegation against petitioner of Cr. Misc. no. 73613 of 2018 is that he along with other co- accused had stolen essential documents relating to landed property along with petitioner, namely, Satyendra Singh @ Satyendra Pd. Singh who is petitioner in Cr. Misc. no. 72994 of 2018 from the house of the informant.
Learned counsel for petitioners submits that other coaccused of this case has already been granted regular bail by this Hon'ble Court vide Cr. Misc. no. 65924 of 2018. From the entire narration of the FIR, it appears that mere suspicion has been raised against these petitioners. Petitioner of Cr. Misc. no. 72994 of 2018 is in custody since 27. 6. 2018 and petitioner of Cr. Misc. no. 73613 of 2018 is in custody since 5.9.2018

Considering the aforesaid, let the petitioners, above named of both the cases, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari /concerned Magistrate in connection with Piprakothi P.S. Case No. 110 of 2018, subject to the condition that both the bailers shall be the close relative of the petitioners.
