====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 27-11-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Ara Nawada P.S. Case No. 02 of 2018 instituted for the offence under Sections 406 and 420 of the Indian Penal Code.
In the written report it is alleged that petitioner had already sold the land in question on 16.3.2015 in favour of Tara Devi. He has executed another sale deed in favour of informant on 15.6.2015 after taking consideration amount of Rs.68,000/-. It is further alleged that informant went for mutation of the land, then she could learn that aforesaid land has already been sold by the petitioner on 16.3.2015 to Tara Devi. Counsel for the petitioner submits that petitioner is ready to make payment of Rs.68,000/- to the informant in two
Patna High Court Cr.Misc. No.67804 of 2018(3) dt.27-11-2018 2/3 equal installment.
In such circumstances, the application is disposed of with direction to the petitioner to make payment of Rs. 34,000/- to the informant by Demand Draft at the time of furnishing bail bond and remaining amount of Rs.34,000/- would be paid by him to the informant within a period of three months from the date of his release. After payment of Rs.34,000/- to the informant by the petitioner at the time of furnishing bail bonds, the Chief Judicial Magistrate, Bhojpur at Ara, will release the petitioner on provisional bail for a period of three months on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each in connection with Ara Nawada P.S. Case No. 02 of 2018 subject to the condition that both the bailors will be the close relatives of the petitioner.
The petitioner is directed to make payment of remaining amount of Rs.34,000/- after three months from the date of his release. The court below will confirm the provisional bail granted to the petitioner after making payment of remaining amount of Rs.34,000/- to the informant as ordered above and on producing the valid receipts showing total payment of Rs.68,000/- to the informant.
