2. The present modification application has been filed for extension of time to surrender before the learned court below as the petitioner has been granted bail earlier vide order dated 02.05.2023 passed in Cr. Misc. No. 69705/2022 by this Court in connection with Pandaul P.S. Case No. 60 of 2022 pending in the court of learned Chief Judicial Magistrate, Madhubani.

3. From perusal of the report of learned Chief Judicial Magistrate, Madhubani, it appears that the present order was passed by his predecessor where fact can be replied out of personal knowledge.

4. Let be so, the period of surrender in the learned court below be extended for two weeks now, as to furnish his

Patna High Court CR. MISC. No.76121 of 2023(3) dt.12-01-2024 2/2 bail bond. Rest of conditions/directions in terms of the order dated 02.05.2023 passed in Cr. Misc. No. 69705 of 2022 shall remain same.

5. Accordingly, the present modification application stands disposed of.
