JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-04-2017 The petitioner is apprehending her arrest in connection with Banasi P.S. Case No. 05 of 2017 registered for offences punishable under Sections 420, 467, 471 and 120 (B) of the Indian Penal Code.

The allegation as per FIR is that one of the coaccused has made interpolation in the marks sheet and showing wrong marks sheet in collusion with the petitioner and other accused has got appointed as contract teacher which on verification, the same has been found not genuine. There is no allegation against the petitioner that she in collusion with the then Mukhia and Punchayat Teacher has committed the aforesaid offence.

It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.16819 of 2017 (3) dt.25-04-2017 2/2 she is a lady and in consultation with the Panchayat Sewak she has made the aforesaid appointment. She is not beneficiary in this case.

Heard learned A.P.P.

The learned A.P.P. has opposed the prayer for bail. Having heard both sides and considering the facts and circumstances as stated above, let the petitioner surrender before the court below and make prayer for regular bail which will be considered by the court below on the basis of allegation made against the petitioner and also considering that the petitioner is a lady and pass appropriate order without being prejudiced by the order of this court, if possible on the same day.
