The petitioner seeks bail in Tankuppa P.S. Case No. 23/2018, instituted for offences under Section(s) 324, 307/34 of the Indian Penal Code read with Section 27 of Arms Act. It is alleged in the written report that on the date of occurrence, son of informant was playing in front of house. At that time, accused persons were filling cartridges in pistol. Petitioner is alleged to have opened firing which hit the son of informant on his right hand and on the right stomach. Injury report is annexed as Annexure-2 wherein doctor has found two lacerated wounds, i.e. on right arm of right hand measuring 1" x1"x 1/2" and on right side of abdomen of
Patna High Court Cr.Misc. No.73221 of 2018(3) dt.09-01-2019 2/2 measuring 1"x1/6"x1/4". Both the injuries are opined to be simple in nature caused by gun shot.
Petitioner is in custody since 31.08.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Gaya in connection with Tankuppa P.S. Case No. 23/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
