2. The petitioner apprehends his arrest in connection with Ara Nagar P.S. Case No. 533 of 2023 registered under Section 304 of the Indian Penal Code.
3. As per F.I.R., it is alleged that in the godown of this petitioner, brother of informant was working as a staff. While working, bags of wheat fell down upon him, thereafter he was taken to hospital and on 30.06.2023, brother of informant died during course of treatment.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case merely because he is owner of the godown in question. It was an accident. Petitioner is no way connected or responsible for the accident. FIR has been lodged
Patna High Court CR. MISC. No.68794 of 2024(2) dt.23-10-2024 2/2 after a delay of 9 days and there is no reasonable explanation for delay. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State opposed the prayer for bail of the petitioner.
6. Having considered the aforesaid facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Nagar P.S. Case No. 533 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Singh, J) utkarsh/- U T
