2. The present application has been filed for modification of the order dated 14.07.2025 passed in Cr. Misc. No. 38827 of 2025 by which the petitioner was granted bail after framing of charge if not already framed in connection with Paraiya P.S. Case No. 390 of 2024 with certain other conditions.

3. Learned counsel for the petitioner submits that the cognizance has been taken against the petitioner and two others on 25.02.2025 and the charge-sheet against the other accused persons has been received along with the case diary on 30.06.2025. Learned counsel for the petitioner further submits

No.68331 of 2025(2) dt.19-09-2025 2/2 that more than a month has elapsed since the communication of the bail order dated 14.07.2025 but, till date, the case has not been committed to the court of sessions and there is no likelihood of framing of charge in this case in near future. He further submits that the original court is now vacant and the incharge court is not taking cognizance. The petitioner is in custody since 04.11.2024.

4. Having heard learned counsel for the parties and after going through the records, this Court does not find any reason to modify the aforesaid order dated 14.07.2025 passed in Cr. Misc. No. 38827 of 2025.

5. Accordingly, the present modification application stands dismissed with a direction to the learned Principal District and Sessions Judge, Gaya to transfer the case to the appropriate court who will take steps for framing of charge expeditiously.
