====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 11-01-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Sarmera P.S. Case No. 25 of 2011, instituted for the offence under Sections 302, 307, 504 of the Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that in the written report there is specific allegation of causing firearm injury on the head of son of informant against co-accused Balendu Bhushan. The informant has given further statement before the police in paragraph-6 of the case diary wherein he has not taken the name of petitioner. The son of informant subsequently died during course of treatment in Rajeshwar Hospital. Thereafter, the statement of informant has been recorded by the police in paragraph 28 of the case diary

Patna High Court Cr.Misc. No.73854 of 2018(3) dt.11-01-2019 2/2 wherein he has taken name of the petitioner. He has levelled specific allegation of causing firearm injury on the head of his son against co-accused Balendu Bhushan.

Petitioner is in custody since 29.9.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Biharsharif, Distt. Nalanda, in connection with Sarmera P.S. Case No. 25 of 2011, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
