JUSTICE SUDHIR SINGH ORAL ORDER 19-11-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered under Sections 224, 120(B) of the Indian Penal Code and Sections-7, 13(1), 13(2) of Prevention of Corruption Act, 1988. Allegedly, the petitioner took the looted money from Teju Choudhary, the brother of the accused namely Anand Choudhary,, and freed the rest three accused persons without any verification or without giving information to the senior police officers.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 21-07-2019. Charge sheet has

Patna High Court CR. MISC. No.62636 of 2019(3) dt.19-11-2019 2/2 already been submitted. The petitioner has been falsely implicated in the present case. The accused persons who were apprehended by the petitioner and other officials, were taken to the local police station and from the said police station, the apprehended persons managed to flee away. For the said occurrence, a case was instituted in which, the petitioner was also made an accused.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance, Patna in connection with Special Case No. 32 of 2019 arising out of Beur P.S.
