JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 10-02-2025 Both the cases arise out of the same case i.e. Bypass P.S. Case No. 34 of 2024 and accordingly, the same are being disposed of by this common order.
2. Heard learned counsel for the petitioners as well as the learned APP for the State.
3. The petitioners apprehend their arrest in connection with Bypass P.S. Case No. 34 of 2024, registered for the
Patna High Court CR. MISC. No.69911 of 2024(3) dt.10-02-2025 2/3 offences punishable under Sections 364, 120(B), 34 of the Indian Penal Code.
4. Allegedly, co-accused, Rajnish Kumar used to visit the informant's house and pretended himself to be unmarried. Meanwhile, the informant's younger sister and Rajnish Kumar fell in love and affection and they got married. Later, she came to know that Rajnish Kumar was already married and had children. It is further alleged that on 28-04-2024, the informant got an information that accused persons named in the FIR had committed murder of his younger sister. The informant has expressed firm belief that the accused persons including the petitioner and other co-accused persons, in a deep conspiracy, had murdered his younger sister namely Renu Kumari and concealed her dead body.
5. The learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case merely because they are the first wife and relatives of the main accused Rajnish Das. They have no complicity in the alleged occurrence.
6. On the other hand, the learned APP for the State has opposed the prayer for bail.
7. The petitioner in Cr. Misc. No. 69911 of 2024 is the
Patna High Court CR. MISC. No.69911 of 2024(3) dt.10-02-2025 3/3 first wife of main accused, Rajnish whereas the petitioners in Cr. Misc. No. 70902 of 2024 are sister-in-law and father-in-law of the deceased. The petitioners conspired and the deceased (informant's sister) was done to death by them. The allegation is serious in nature.
8. Considering the above-mentioned facts and circumstances as well as the gravity of the allegation, I do not think it to be a fit case for grant of anticipatory bail, which is hereby rejected.
9. However, if the petitioners surrender in the court below and seek regular bail, the same shall be considered on its own merit without being prejudiced by this order. (Nawneet Kumar Pandey, J) Nirmal/- U
