JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 26-09-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Araria P.S. Case No. 157 of 2019 (G.R. No. 720 of 2019) for the offenses under Sections 457 and 380 of the Indian Penal Code. Learned counsel for the petitioner would submit that the name of the petitioner surfaced on the confessional statement of co-accused Rohit Kumar Verma alias Akshay Kumar Verma alias Soni. He submits that the petitioner is in custody since 22.4.2019. The FIR was lodged against unknown and nothing incriminating was recovered from the possession of the petitioner to connect the petitioner in the commission of the crime.

Considering the aforesaid the court is inclined to

Patna High Court CR. MISC. No.60307 of 2019(2) dt.26-09-2019 2/2 grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 50,000/-(Fifty Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 157 of 2019 (G.R. No. 720 of 2019).
