Petitioner apprehends arrest in a case registered for the offences punishable under Sections 30(a), 36 and 41(i) of the Bihar Prohibition and Excise (Amendment) Act. As per prosecution case, 1933.560 liters of foreign liquor has been recovered from a Truck bearing registration No. UP16 ET 2136.

Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Petitioner is neither driver nor owner of the truck in question. No incriminating material has been recovered from the conscious

Patna High Court CR. MISC. No.64793 of 2022(2) dt.16-12-2022 2/2 possession of the petitioner. Petitioner has got no criminal antecedent.

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Excise Court-I, Samastipur in Musrigharari P.
